Terms of Service for Cabexa Cabs

These Terms of Service ("Terms") govern the use of transportation services provided by Cabexa Cabs ("Cabexa," "we," "us," or "our"), a cab service operating in India, specifically providing pick-up and drop-off services for students of Axisa Academy. The services are booked by parents or legal guardians ("Parent/Guardian," "you," or "your") on behalf of students under 18 years of age ("Student"). By booking or using our services, you agree to be bound by these Terms. Please read them carefully before making a booking.
1. Definitions
- Cabexa Cabs: A cab service provider offering pick-up and drop-off services for students of Axisa Academy, registered under [Insert Legal Entity Name] with offices at [Insert Registered Address].
- Parent/Guardian: An individual (18 years or older) who is the parent or legal guardian of a Student, authorized to book services on their behalf.
- Student: A minor (under 18 years) enrolled at Axisa Academy who uses Cabexa Cabs’ transportation services.
- Booking: A reservation for pick-up and drop-off services made by a Parent/Guardian via the Cabexa Cabs website, mobile app, or reservation center.
- Zoho Payments: The payment gateway service integrated with Cabexa Cabs for processing online payments.
- Services: Pick-up and drop-off transportation services for Students to and from Axisa Academy or designated locations.
- Charges: The fare for the booked service, including base fare, distance-based charges, and applicable taxes.
- Additional Charges: Fees for services such as waiting time, multiple stops, or cleaning fees due to soiling of the vehicle.
2. Eligibility
- Booking Eligibility: Only Parents/Guardians who are 18 years or older and have the legal authority to act on behalf of a Student may book services with Cabexa Cabs.
- Student Eligibility: Students under 18 years of age enrolled at Axisa Academy are eligible to use the services, provided a Parent/Guardian books and consents to the transportation.
- By booking, the Parent/Guardian confirms they have the legal capacity to enter into these Terms, and all provided information (including Student and Parent/Guardian details) is accurate.
3. Booking Process
- How to Book:
- Bookings must be made by a Parent/Guardian through the Cabexa Cabs website, mobile app, or by contacting our 24/7 reservation center at [Insert Contact Number] or [Insert Email].
- Provide accurate details, including:
- Student’s name, age, and any special requirements (e.g., child seats, medical conditions).
- Pickup and drop-off locations (e.g., home, Axisa Academy, or other designated points).
- Date, time, and frequency (e.g., daily, weekly).
- For recurring bookings (e.g., daily school transport), a subscription plan may be set up with prior agreement.
- Confirmation:
- Upon booking, the Parent/Guardian will receive a confirmation via SMS or email with ride details, including driver and vehicle information.
- For Student safety, the Parent/Guardian will receive real-time updates on ride status (e.g., pickup confirmation, drop-off confirmation).
- Modifications and Cancellations:
- Modifications (e.g., change in pickup time or location) can be made up to 1 hour before the scheduled pickup, subject to availability.
- Cancellations made at least 2 hours before the pickup time are eligible for a full refund, minus any processing fees charged by Zoho Payments (if applicable). Cancellations within 2 hours may incur a cancellation fee of ₹100 or 20% of the base fare, whichever is higher.
- No refunds for no-shows or cancellations after the driver arrives at the pickup location.
- For subscription plans, cancellation terms will be specified in the subscription agreement.
4. Payment Terms
- Payment Methods:
- Payments can be made via Zoho Payments (supporting credit/debit cards, UPI, and net banking) or cash/UPI directly to the driver (with prior approval).
- Parents/Guardians must provide valid payment details at the time of booking for online payments. Cabexa Cabs uses Zoho Payments to securely process transactions.
- Fare Structure:
- Standard pick-up and drop-off: ₹8 per kilometer, with a minimum base fare of ₹100 per trip.
- Subscription plans: Monthly plans starting at ₹2,500 for daily pick-up and drop-off (based on fixed routes and distances).
- Additional Charges: Include waiting time (₹50 per 15 minutes), multiple stops (₹50 per stop), and cleaning fees (minimum ₹500 for soiling the vehicle).
- All fares are inclusive of applicable taxes (e.g., GST).
- Payment Processing:
- For online payments, Charges are processed at the time of booking or as per the subscription plan schedule. Additional Charges (e.g., waiting time, cleaning fees) are processed after ride completion using the same payment method.
- If a payment is declined, Cabexa Cabs may attempt to charge another registered payment method or require cash payment.
- Refunds:
- Refunds for cancellations or overcharges will be processed via Zoho Payments within 7–10 business days.
- No refunds for completed rides unless due to a service failure attributable to Cabexa Cabs (e.g., driver no-show).
- Disputes:
- Payment disputes must be reported to Cabexa Cabs within 7 days of the transaction at [Insert Contact Email].
- Zoho Payments’ dispute resolution policies apply to online transactions.
5. Parent/Guardian and Student Responsibilities
- Accurate Information:
- Parents/Guardians must provide correct details about the Student (e.g., name, age, emergency contact) and pickup/drop-off locations.
- Notify Cabexa Cabs of any special needs (e.g., medical conditions, mobility requirements) at the time of booking.
- Student Conduct:
- Students must follow driver instructions and behave respectfully. No eating, drinking (except water), or disruptive behavior is allowed inside the vehicle.
- Parents/Guardians are liable for any damage or soiling of the vehicle caused by the Student, with a minimum cleaning fee of ₹500.
- Safety:
- Students must wear seatbelts at all times, as required by Indian law.
- Parents/Guardians must ensure Students are ready at the designated pickup time and location.
- For Students under 12 years, a Parent/Guardian or authorized adult must be present at drop-off to receive the Student, unless prior written consent is provided for unaccompanied drop-off.
- Luggage and Belongings:
- Students are responsible for their belongings (e.g., school bags). Cabexa Cabs is not liable for lost or damaged items.
- Oversized luggage (e.g., sports equipment) may incur an additional fee of ₹50–₹100, depending on size.
- Child Seats:
- Child seats are mandatory for Students under 5 years or as requested by the Parent/Guardian, provided at an additional charge of ₹100 per seat per trip.
- Parents/Guardians are responsible for verifying proper installation and use of child seats.
6. Cabexa Cabs’ Responsibilities
- Service Quality:
- Provide clean, well-maintained vehicles driven by licensed, background-verified, and trained drivers.
- Ensure timely pickups and drop-offs, subject to traffic and unforeseen circumstances.
- Student Safety:
- Drivers are trained to handle minors with care and follow strict safety protocols.
- Vehicles are equipped with GPS tracking, and Parents/Guardians receive real-time ride updates (e.g., pickup and drop-off notifications).
- Emergency contact numbers are provided for each ride.
- Driver Conduct:
- Drivers undergo background checks and are trained to maintain professionalism, especially when transporting minors.
- Any complaints about driver behavior can be reported to [Insert Contact Email or Number] for immediate investigation.
- Regulatory Compliance:
- Compliance with Indian transport regulations, including valid permits, vehicle insurance, and driver licenses.
- Adherence to child safety guidelines as per the Motor Vehicles Act, 1988, and other applicable laws.
7. Limitations of Liability
- Service Interruptions:
- Cabexa Cabs is not liable for delays or cancellations due to unforeseen circumstances (e.g., traffic, weather, vehicle breakdowns, or force majeure events like strikes or natural disasters).
- Personal Injury or Property Damage:
- Cabexa Cabs is not liable for personal injury or property damage unless directly caused by the negligence of our driver or vehicle.
- Parents/Guardians assume responsibility for injuries or damages resulting from the Student’s actions or failure to follow safety guidelines.
- Lost Items:
- Cabexa Cabs will make reasonable efforts to return lost items but is not liable for losses. Parents/Guardians must report lost items within 24 hours to [Insert Contact Email or Number].
- Unaccompanied Minors:
- For unaccompanied drop-offs (with prior written consent), Cabexa Cabs is not liable for incidents occurring after the Student is dropped off at the designated location.
8. Privacy and Data Protection
- Data Collection:
- Cabexa Cabs collects personal information from Parents/Guardians (e.g., name, contact details, payment information) and Students (e.g., name, age, pickup/drop-off details) to process bookings and ensure safe transportation.
- Payment data is securely processed via Zoho Payments, and Cabexa Cabs does not store sensitive payment details (e.g., card numbers) beyond what is required for transactions.
- Data Use:
- Data is used for booking confirmations, ride updates, and emergency communications.
- With consent, Parents/Guardians may receive promotional offers related to Cabexa Cabs’ services.
- Student data is handled with strict confidentiality and used solely for transportation purposes.
- Data Security:
- We comply with the Information Technology Act, 2000, and other applicable data protection laws in India, including the Digital Personal Data Protection Act, 2023 (if applicable).
- Reasonable measures are implemented to protect data, but Cabexa Cabs is not liable for breaches beyond our control (e.g., third-party cyberattacks).
9. Termination of Services
Cabexa Cabs reserves the right to refuse or terminate service to any Parent/Guardian or Student who:
- Violates these Terms (e.g., abusive behavior, non-payment, providing false information).
- Engages in activities that compromise safety or disrupt services.
No refunds will be issued for terminated services due to misconduct by the Parent/Guardian or Student.
10. Dispute Resolution
- Governing Law: These Terms are governed by the laws of India, with jurisdiction in [Insert City/State, e.g., New Delhi].
- Resolution Process:

12. Compliance with Zoho Payments
- All online payments are processed through Zoho Payments, subject to their terms and conditions (available at https://www.zoho.com/in/payments/terms.html).
- Cabexa Cabs complies with Zoho Payments’ requirements for secure transactions, including PCI DSS compliance and fraud prevention measures.
- Parents/Guardians are responsible for ensuring their payment methods are valid and compliant with Zoho Payments’ policies.
13. Miscellaneous
- Force Majeure: Cabexa Cabs is not liable for failure to perform services due to events beyond our control, including natural disasters, government restrictions, or strikes.
- Parental Consent: By booking, Parents/Guardians provide explicit consent for Cabexa Cabs to transport their Student(s) and agree to the safety and conduct terms outlined herein.
- Severability: If any provision of these Terms is found invalid, the remaining provisions remain in effect.
- Entire Agreement: These Terms constitute the entire agreement between Cabexa Cabs and the Parent/Guardian, superseding any prior agreements.
